General Terms & Conditions

1. Scope

The following Terms & Conditions apply to all orders placed in our online shop.

2. Contracting party, contract agreement

The purchase contract is concluded with NEC PLUS ULTRA GmbH. By offering the products for sale in the online shop, we are making a binding offer to enter into a contract for these items. You may place products in the online shopping basket without any obligation. You may also update your shopping basket at any time prior to submitting your binding order using the correction functions provided and described during the order process. The contract is binding once you accept the stipulated price for the goods in the basket by clicking on the order button. You will receive an order confirmation by e-mail immediately after submitting the order.

A binding contract can also be entered into in advance as follows:

  • If you have selected to pay by credit card, the contract will be entered into when your credit card is charged.
  • If you have selected PayPal as your payment method, the contract will be entered into when you confirm the payment instruction to PayPal.

The contract is available in German and English. We will save the contract and send you the order information and our Terms & Conditions by e-mail. You may view and download the Terms & Conditions from our website at any time. You can also view past orders in the customer login area.

3. Delivery conditions

In addition to the product prices stated, we charge a EUR 4.90 delivery charge for orders under EUR 65. Delivery is free of charge for orders over EUR 65. We only deliver by carrier. This means that it is not possible to pick up the order in person.

4. Payment

The following payment options are available in our shop:

Credit card

Your card will be charged at the time of order.

PayPal

You can pay the amount due through the online payment provider PayPal. This requires that you register with PayPal, verify your account details and then confirm the payment instruction to us. Further help will be provided during the order process.

Invoicing through Klarna AB

Payment by invoice and finance agreement

We offer the option to pay on account or in instalments in partnership with Klarna  AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Please note that purchase on account and hire purchase are only available to consumers and that the payment must be made to Klarna in each instance.

Invoice

When purchasing on account through Klarna, you always receive the goods first. You must then pay the amount owed within 14 days of receipt of the goods. You can find the complete Terms & Conditions regarding purchases on account here . The online shop charges a fee of EUR 0.00 per order for purchases on account through Klarna.

Hire purchase

You can use Klarna’s finance agreement service to pay for your purchase in flexible monthly instalments of at least 1/24 of the total amount (starting from a minimum monthly payment of €6.95) or in accordance with the conditions otherwise stated at the point of sale. Data protection notice

Klarna verifies and evaluates your data and will forward data to other companies and credit agencies if there is a legitimate interest and reason to do so. Your personal information is processed in accordance with the applicable data protection regulations and the information in  Klarna’s data protection regulations .

5. Retention of title

The goods remain our property until payment is made in full.

6. Damage in transit

If goods are delivered with obvious damage that occurred during transport, please report this damage to the carrier as soon as possible and contact us immediately. Failure to register the complaint or contact us will have no consequences for statutory claims or their enforcement, especially warranty rights. Reporting the matter will, however, enable us to validate our own claims against the carrier or transport insurance company.

7. Warranty and guarantees

8. Online dispute resolution

Online dispute resolution in accordance with Art. 14 (1) of the ODR Regulation: The European Commission provides a platform for online dispute resolution (ODR) that can be found at  http://ec.europa.eu/consumers/odr/ .

9. Cancellation policy

You have the right to withdraw from this contract within 14 days without stating a reason. The cancellation period is 14 days from the date that you or a third party known to you who is not the carrier took possession of the goods. To exercise your right to cancel, you must contact:

in writing (e.g. by means of a letter sent by post or e-mail), clearly stating your decision to withdraw from the contract. To meet the cancellation deadline, you simply need to send your message regarding your decision to withdraw before the cancellation period expires. The costs for returning the goods are the responsibility of the customer.

Cancellation consequences

If you revoke this contract, we will immediately refund all payments we have received from you, including delivery costs (with the exception of any additional costs if you chose a different type of delivery than the cheapest standard delivery offered by us) and no later than 14 days of the date on which we receive your message stating your revocation of this contract. We will use the same payment method for this repayment that you used for the original transaction, unless we have expressly agreed otherwise with you. Under no circumstances will we charge you for this repayment. We may postpone a refund of all payments until we have received the goods or until you have proven that you have sent the goods to us, whichever is earlier. The deadline applies if you return the goods before the end of the 14-day period. Should a package arrive incomplete, you are required to contact us within 48 hours. You will only have to pay for any loss in the value of the goods if this loss in value is because the goods were handled in a manner that was not necessary to verify the nature, properties and functionality of the goods.

Exclusion of the right to cancellation

The right of revocation does not apply to contracts for the delivery of goods that can spoil quickly or whose expiration date is approaching. The right of revocation expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal was removed after delivery.
